Welcome to Yacht Away Now. These Terms of Service ("Terms") govern your use of the website yachtawaynow.com (the "Site") and all yacht charter services provided by Yacht Away Now LLC ("we," "us," or "our"). By accessing the Site or booking a charter, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

1. Booking and Reservations

All charter bookings are subject to availability and are confirmed only upon receipt of the required deposit or full payment. By submitting a booking request, you represent that all information provided is accurate and complete. Charter dates, times, and itineraries are subject to change based on weather conditions, vessel availability, and captain discretion. We recommend booking at least 2-4 weeks in advance, particularly for weekends and holidays.

2. Cancellation Policy

All bookings are final. Contact us to discuss rescheduling options.

3. Weather Cancellations

Safety is our top priority. The captain has sole and absolute discretion to cancel, delay, shorten, or alter any charter due to weather conditions, sea state, or any other safety concern. If a charter is cancelled by Yacht Away Now due to weather or unsafe conditions, you will be offered the option to reschedule at no additional cost. Weather-related decisions made by the captain are final and not subject to dispute.

4. Guest Conduct

All guests are expected to conduct themselves in a respectful and responsible manner while aboard the vessel. The captain and crew reserve the right to terminate a charter if any guest engages in behavior that is dangerous, disruptive, illegal, or damaging to the vessel or its equipment. Guests are financially responsible for any damage to the vessel, furnishings, or equipment caused by negligence or misconduct during the charter.

5. Age Requirements

All guests under the age of 18 must be accompanied by a parent or legal guardian at all times during the charter. The booking party must be at least 21 years of age. Guests of all ages are welcome aboard; however, the safety and supervision of minors is the sole responsibility of their accompanying parent or guardian.

6. BYOB and Food Policy

Guests are welcome to bring their own food, beverages (including alcohol), and decorations aboard. All alcoholic beverages must be consumed responsibly. The captain reserves the right to limit or prohibit alcohol consumption if it poses a safety concern. Glass containers are permitted but must be handled with care. Guests are responsible for removing all personal items and trash at the conclusion of the charter. Excessive cleaning fees may apply if the vessel is left in an unreasonable condition.

7. Assumption of Risk

Yacht chartering and water-based activities involve inherent risks, including but not limited to drowning, injury from slips and falls, exposure to sun and weather, seasickness, and other hazards associated with boating and open water. By boarding the vessel, all guests voluntarily assume all risks associated with the charter and water activities. Guests who cannot swim or have medical conditions that may be affected by water activities should inform the captain prior to departure.

8. Limitation of Liability

To the fullest extent permitted by law, Yacht Away Now LLC, its owner, officers, employees, captain, and crew shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from or related to your use of our services, including but not limited to personal injury, property damage, loss of enjoyment, or any other loss. Our total liability for any claim shall not exceed the total charter price paid by you for the specific charter giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Yacht Away Now LLC, its owner, employees, captain, and crew from any claims, damages, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your use of our services, your violation of these Terms, or the actions of any guest in your party.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida. You consent to the personal jurisdiction of such courts.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of our Site or services following any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
